Terms of Service

By creating a Makazi account or using the platform you agree to these Terms of Service. If you are accepting on behalf of an organisation, you confirm you have authority to bind that organisation. These Terms are governed by the laws of Kenya.

Makazi Technologies Ltd provides a cloud-based property management platform including: automated billing, M-Pesa payment processing, KRA eTIMS invoice generation, tenant and lease management, maintenance tracking, and reporting. We reserve the right to modify or discontinue features with reasonable notice.

You are responsible for maintaining the security of your account credentials. You must not share login credentials or allow unauthorised access. Notify us immediately at security@makazi.co.ke if you suspect a security breach. Each subscription is for a single organisation. You may not use one account to manage properties for multiple independent organisations without a separate subscription for each.

Subscriptions are billed monthly in advance. Prices are in Kenyan Shillings (KES) and exclude VAT where applicable. Your 14-day free trial provides full Professional-tier access. No credit card is required during the trial. At trial end, you must subscribe to continue using the platform. Data is not deleted at trial expiry — your account is paused and reactivatable within 30 days. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not issue pro-rated refunds for unused days.

You agree not to: - Use the platform to process transactions for properties you do not own or manage - Attempt to reverse-engineer, scrape, or copy the platform - Transmit malware or conduct security attacks - Misrepresent your identity or organisation - Use the platform for any purpose that violates Kenyan law We may suspend accounts that violate these terms without notice.

You retain ownership of all data you enter into Makazi (tenant information, lease terms, payment records, etc.). We process this data on your behalf as a data processor under the Kenya Data Protection Act 2019. Our Privacy Policy at makazi.co.ke/privacy describes how we handle personal data. By using the platform you agree to that policy.

Makazi facilitates M-Pesa transactions via Safaricom's Daraja API. You are responsible for maintaining a valid Safaricom Daraja API account and paybill number. Transaction processing is subject to Safaricom's terms. We are not liable for payment failures, delays, or reversals caused by Safaricom, Africa's Talking, Meta, or other third-party services.

Makazi generates KRA eTIMS-compliant invoices and tax receipts based on the data you provide. You remain responsible for the accuracy of that data and for filing tax returns with the Kenya Revenue Authority. Makazi does not provide tax advice.

We target 99.9% monthly uptime for Professional and Enterprise plans. Scheduled maintenance windows are announced at least 24 hours in advance. Unplanned downtime does not entitle you to a refund unless specified in an Enterprise SLA agreement. Support is provided via email (support@makazi.co.ke) during business hours (Mon–Fri, 8 am–6 pm EAT). Priority support is available on Professional and Enterprise plans.

To the maximum extent permitted by Kenyan law, Makazi's total liability for any claim arising from these Terms or your use of the platform is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential losses including lost revenue, lost data, or business interruption.

We may update these Terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.
